REGULAR COUNCIL MEETING JANUARY 26 2009
MINUTES
1. CALL TO ORDER AT 7:00 P.M.
2. PLEDGE OF ALLEGIANCE
3. ATTENDANCE
Taken at ZBA. Present: Kucinich, Kirklin, Bemer, McLean, Markle, Spulick, Ashbaugh.
Others present: Attorney Graham, Chief VerHage, Craig Shumaker, Karl Freed, Claudia Spulick and others.
4. WELCOME TO THE PUBLIC
5. ANNOUNCEMENT OF MEETING BEING RECORDED
6. OPEN PUBLIC HEARING ON COMMUNITY PARKS AND RECREATION PLAN
Motion by Kucinich, support by Bemer, to open the public hearing on the Community Parks
and Recreation Plan. All members voted in favor. Motion carried.
7. PUBLIC COMMENT - none
8. CLOSE PUBLIC HEARING
Motion by Bemer, support by Kucinich, to close the public hearing. All members voted in
favor. Motion carried.
9. ADDITIONS TO THE AGENDA - none
10. APPROVAL OF THE AGENDA
Motion by Kucinich, support by Kirklin, to approve the agenda as printed. All members voted in favor. Motion carried.
11. APPROVAL OF THE MINUTES OF JANUARY 12, 2009 and JANUARY 19, 2009
Motion by Kirklin, support by Markle, to approve the minutes of January 12, 2009 with correction on page 2. All members voted in favor. Motion carried.
Motion by Kucinich, support by Kirklin, to approve the minutes of January 19, 2009. Six members voted in favor with one abstaining due to absence. Motion carried.
12. BILLS TO BE APPROVED IN THE AMOUNT OF $70,578.13
Motion by Kirklin, support by Markle, to pay the bills in the amount of $70,578.13. Roll call vote taken. Six members voted yes. Bemer voted no to the Fleis & Vandenbrink bill only until further research could be done. Motion carried.

14. BOARD AND COMMITTEE REPORTS
A. PLANNING COMMISSION JANUARY 21, 2009
Liaison Markle was not at the meeting, please refer to the minutes.
The planning commission reviewed the site plan review for the bank and talked about getting a new Condo ordinance.
15. STAFF REPORTS
A. POLICE REPORT – CHIEF VERHAGE
Chief VerHage stated the Police Department served 10 citations in December. They also serviced 89 calls. He reported that Officer Hutchins injured himself and would be out of work until mid February. There is not an officer on duty at the school, but the department is taking care of all school problems. He also stated that Officer Hitchcock resigned, and he hired Brian Ellerbrook as a part time officer.
16. OLD BUSINESS
A. STIMULUS PACKAGE PROJECTS
Craig Schumaker spoke with the Rural Development about the stimulus package. He wanted to know if it would be smart to add on to an existing application or to file a new one for the water project. They said it would be best with an application already on file. We will have priorities because of the
existing application and will just have to add additional projects and redo some of the paperwork. The Grant loan ratio will be better. Others will be submitting new applications while we will already have one on file. Schumaker will be sitting down with Todd Maclean and go over the project list to see what is the best way to go and then come back to Council. The Village has no sewer projects open so if we plan that for the stimulus project we would have to submit a new sewer application.
17. NEW BUSINESS
A. ADOPT RESOLUTION FOR COMMUNITY RECREATION PLAN
Motion by Markle, support by Bemer, to adopt the new Community Recreation Plan with a few typing errors and dates to be corrected. Roll call vote taken. All members voted in favor. Motion carried.
18. COMMUNICATIONS
a. MML Legislative Link for January 13 & 20, 2009
b. Thank you letter
c. Letter from City of Kalamazoo regarding “true up” charges for sewer treatment
Attorney Graham will be looking at the settlement agreement from the City of Kalamazoo to see if these charges are feasible.
Motion by Bemer, support by Kirklin, to allow Attorney Graham to look at the settlement agreement. Roll call vote taken. All members voted in favor. Motion carried.
d. Letter from Texas Township regarding comprehensive plan and future land map

19. COMMENTS FROM VISITORS
Chris Ballingall had questions about the stimulus plan about paving Root Road, which no paving is part of the plan. She also questioned sewer and water down 25th Street which is listed on the plan.
20. COMMENTS FROM COUNCIL
Kucinich asked about the training class for the Planning Commission. She wanted to let Ruth know that the Thursday class is not good for three of the Planning Commission members.
Bemer stated her and Chief VerHage are discussing putting together a neighborhood watch for the whole Village.
